1. Introduction

Welcome to YouHook ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of our peer-to-peer rental marketplace platform, including our website, mobile applications, and related services (collectively, the "Platform").

By accessing or using YouHook, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform.

2. Definitions

  • "Owner" refers to a user who lists items for rent on the Platform.
  • "Renter" refers to a user who rents items from Owners through the Platform.
  • "Listing" refers to an item made available for rent by an Owner.
  • "Rental Period" refers to the agreed-upon duration for which an item is rented.
  • "Security Deposit" refers to a refundable amount held to cover potential damages or losses.
  • "YouHook Coverage" refers to our protection program for qualifying rentals.

3. Eligibility

To use YouHook, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding contracts
  • Provide accurate and complete registration information
  • Not be prohibited from using the Platform under applicable laws
  • Complete identity verification as required for Verified User status

4. Account Registration and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Update your information to keep it accurate, current, and complete
  • Immediately notify us of any unauthorized use of your account
  • Not share your account credentials with any third party
  • Not create multiple accounts for fraudulent purposes

5. Listing Items (For Owners)

As an Owner, you represent and warrant that:

  • You have the legal right to rent out the items you list
  • All information provided in your Listings is accurate and not misleading
  • Your items are safe, functional, and suitable for their intended use
  • You will comply with all applicable laws and regulations
  • You will not list prohibited items (weapons, illegal substances, hazardous materials, stolen property, etc.)

Owners may set rental prices by the day or by the hour. YouHook reserves the right to remove any Listing that violates these Terms.

6. Renting Items (For Renters)

As a Renter, you agree to:

  • Use rented items only for their intended purpose and in accordance with the Owner's instructions
  • Return items on time and in the same condition as received (normal wear and tear excepted)
  • Not sublease or transfer rented items to third parties
  • Pay all rental fees, security deposits, and any applicable charges
  • Report any damage or issues immediately through the Platform
  • Provide accurate pickup and return information

7. Fees and Payments

YouHook operates with a commitment to keeping costs low. Our fee structure includes:

  • Service Fee: A percentage-based fee applied to rental transactions to maintain and improve the Platform
  • Processing Fee: A $2.70 processing fee for payment handling
  • Security Deposit: Refundable deposits set by Owners to protect against damage or loss
  • Delivery Fees: If applicable, fees for item delivery as specified in the Listing

All payments are processed securely through our payment partners. Payouts to Owners are automatic upon successful completion of rentals and can be tracked under "Account" > "Payouts."

8. Security Deposits

Security deposits are held to protect Owners against potential damage, loss, or late returns. The deposit amount is set by the Owner and displayed on each Listing.

  • Deposits are authorized at the time of booking and captured only if a claim is filed
  • If an item is returned in satisfactory condition, the deposit authorization is released
  • Disputes regarding deposits will be handled through our resolution process

9. YouHook Coverage

YouHook Coverage provides protection for qualifying rentals against theft, damage, and certain other incidents. Coverage details include:

  • Protection limits vary based on the item category and rental value
  • Claims must be filed within 48 hours of the incident
  • Documentation and evidence may be required to process claims
  • Certain exclusions apply (intentional damage, prohibited use, etc.)

10. Cancellation Policy

Cancellation policies may vary by Listing. Generally:

  • Cancellations made 24+ hours before the rental start time may qualify for a full refund
  • Cancellations made less than 24 hours before may incur fees
  • No-shows may result in forfeiture of the rental fee
  • Owners who cancel confirmed bookings may face penalties

11. Prohibited Conduct

You agree not to:

  • Violate any applicable laws, regulations, or third-party rights
  • Use the Platform for any fraudulent or illegal purpose
  • Circumvent the Platform to conduct off-platform transactions
  • Post false, misleading, or defamatory content
  • Harass, threaten, or discriminate against other users
  • Attempt to gain unauthorized access to the Platform or other users' accounts
  • Use automated systems to access the Platform without permission
  • Interfere with the proper functioning of the Platform

12. Intellectual Property

The YouHook name, logo, and all related marks, designs, and content on the Platform are the property of YouHook or its licensors. You may not use, reproduce, or distribute our intellectual property without prior written consent.

By posting content on the Platform (including Listing descriptions and photos), you grant YouHook a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with operating and promoting the Platform.

13. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. YOUHOOK DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

YouHook is a marketplace platform that connects Owners and Renters. We do not own, control, or inspect the items listed on the Platform and are not responsible for the quality, safety, or legality of any Listing.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOUHOOK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR ACCESS TO OR USE OF THE PLATFORM.

15. Indemnification

You agree to indemnify, defend, and hold harmless YouHook, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Platform, your violation of these Terms, or your violation of any rights of another party.

16. Dispute Resolution

In the event of a dispute between users, YouHook provides a resolution process through our platform. Users are encouraged to first attempt to resolve disputes directly through our messaging system.

For disputes that cannot be resolved informally, you agree to binding arbitration in accordance with the rules of the American Arbitration Association. Class action lawsuits and class-wide arbitrations are not permitted.

17. Modifications to Terms

YouHook reserves the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Platform and updating the "Last updated" date. Your continued use of the Platform after such changes constitutes acceptance of the modified Terms.

18. Termination

YouHook may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination:

  • Your right to access and use the Platform will immediately cease
  • Any pending rentals may be cancelled
  • Outstanding payments and obligations will remain due

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
